Terms of Service

Welcome to Talkeeper ("Company," "we," "our," "us"). By accessing or using our website (the "Site") or our services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use our Site or services.

1. Eligibility and access

Our Site and services are intended for individuals 18 years of age or older. If you are under 18, you may not use or interact with our Site.

We reserve the right to deny or restrict access to any user at our discretion.

2. Use of website content

All content on this Site, including text, graphics, logos, and code, is owned by or licensed to Talkeeper and is protected by copyright and intellectual property laws.

You may not copy, distribute, modify, publish, or exploit any portion of the Site for commercial use without our prior written consent. Limited personal use is permitted for browsing and informational purposes only.

3. Services

Talkeeper provides AI-powered call answering, appointment booking, and lead revival services for businesses. The service is configured for each client during install, including call handling rules, escalation rules, and calendar and software connections. The specific scope of your service is set out in your service agreement or order form.

Subscriptions run month to month unless otherwise agreed in writing. Not all services described on the Site apply to every client engagement.

4. Service guarantees

Where Talkeeper offers written service guarantees on the Site, including "Every call she handles is answered and logged, or the month is free" and "Live and answering in 7 days, or onboarding is free," those guarantees apply as stated, subject to the conditions published alongside them, including completion of the client's knowledge-base setup, the exclusion of spam and wrong numbers, and the stated caps on remedies. The 7-day period starts the day your knowledge-base setup is complete.

5. Demo line, call recording, and consent

Our demonstration line at (833) 309-3857 is answered by an AI agent. Bookings made on the demonstration line are demonstrations only, not real appointments or dispatches.

Calls placed to phone lines answered by Talkeeper may be recorded and transcribed as described in our Privacy Policy. Where the law of your state requires the consent of everyone on a call to record it, notice is provided and your continued participation after that notice constitutes your consent.

If you provide your mobile number and agree to receive a booking confirmation, you consent to receive that confirmation by text message. Message and data rates may apply. Reply STOP to opt out.

6. Payment and currency

All transactions are processed in USD ($) unless otherwise agreed in writing. Accepted payment methods are stated in your service agreement or invoice.

7. Cancellations and refunds

Month-to-month subscriptions may be cancelled by written notice, effective at the end of the current billing cycle. On cancellation we turn off call forwarding at no charge and your number continues to work exactly as before.

Fees already paid are generally not refundable once services have started, except as provided by a written service guarantee or as otherwise agreed in writing.

8. Disclaimer of warranties

Except for the written service guarantees described in Section 4, the Site and services are provided "as is." We make no other warranties, express or implied, regarding the completeness, accuracy, or results from using our Site or services.

Use of the Site is at your own risk. We are not responsible for damage to your computer, software, or data from use of the Site or from downloads.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or services. Our total liability for any claim is limited to the amounts you paid to us for the service in the month the claim arose, or the remedy stated in an applicable written service guarantee, whichever applies.

10. Indemnification

You agree to indemnify and hold harmless Talkeeper, its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Site or services or violation of these Terms.

11. User submissions

Any feedback or ideas you voluntarily provide about the Site or services may be used by us for business purposes without obligation to compensate you. This section does not apply to your business's own data handled through the service, which is addressed in your service agreement and our Privacy Policy.

12. Third-party links

Our Site contains links to third-party sites and services, including Calendly for scheduling. We are not responsible for the content, policies, or practices of such sites.

13. Dispute resolution and arbitration

Binding arbitration: any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled by binding arbitration in Hillsborough County, Florida, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

Class action waiver: you agree that any arbitration or proceeding shall be limited to the dispute between you and Talkeeper individually. To the fullest extent permitted by law, you waive any right to bring claims on a class action basis or to participate in a class action lawsuit.

Exceptions: either party may seek injunctive or other equitable relief in state or federal courts located in Hillsborough County, Florida, to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these Terms (not subject to arbitration) will be brought exclusively in the federal or state courts located in Hillsborough County, Florida, and you consent to personal jurisdiction and venue therein.

15. Changes to terms

We may update these Terms at any time by posting a revised version on this page with an updated effective date. Continued use of the Site or services after changes means you accept the new Terms.
